Please read these Terms of Service ("Terms") carefully. These Terms govern your access to and use of the Simran mobile application (the "App"), provided by FocusPledge LLC ("FocusPledge," "we," "us," or "our").
By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you are expressly prohibited from using the App and must discontinue use immediately.
You confirm that you are at least 13 years of age. If you are a minor in your jurisdiction, you represent that you have the permission of your parent or legal guardian to access and use the App, and that your parent or guardian has read and agreed to these Terms on your behalf.
Subject to your compliance with these Terms, FocusPledge LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the App for your personal, non-commercial use on a single device owned or controlled by you.
A. Our Content: All content, features, and functionality of the App, including the underlying Shabad interpretations, the structure of the AI companion, text, graphics, logos, and proprietary code, are the exclusive property of FocusPledge LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
B. Sacred Content: The sacred Sikh scriptures (Guru Granth Sahib Ji, Hukamnama, and Shabads) presented within the App are historical religious texts. FocusPledge LLC makes no claim of ownership over the original sacred texts themselves.
C. Restrictions: You agree not to copy, modify, distribute, sell, or lease any part of the App or its intellectual property, nor may you reverse engineer, decompile, or attempt to extract the source code of the App.
A. User Content: If you submit feedback, suggestions, spiritual queries, or other content ("User Content") through the App, you grant FocusPledge LLC a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content (in whole or in part) for the purpose of operating, improving, and promoting the App and its services.
B. Query Training: You acknowledge that all queries and interactions with the AI companion (AI Interaction Data) may be analyzed and retained (often in an anonymized form) to train, refine, and improve the accuracy and spiritual relevance of the underlying AI models.
A. Educational and Spiritual Use: The Simran App provides content, interpretations, and spiritual guidance derived from the Guru Granth Sahib Ji for educational and inspirational spiritual purposes only. The App is not intended to replace consultation with a qualified Sikh scholar (Giani/Granthi) or community leader, or to serve as official religious edict.
B. No Guarantee of Accuracy: While we strive for spiritual authenticity and accuracy, FocusPledge LLC does not guarantee that the content, interpretations, Hukamnama readings, or AI responses are always error-free, uninterrupted, or suitable for any specific individual or religious decision. All use of the App and reliance on its content is strictly at your own risk.
C. Limitation of Liability: In no event shall FocusPledge LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any content obtained from the App; and (iii) unauthorized access, use, or alteration of your transmissions or content.
